1. Use of the
Gasflair.co.uk site
The site is provided to you free of charge for your personal use. By using
the site you agree to be bound by these Terms and Conditions.
These Terms and Conditions govern the use of
the site and all the services provided in connection with it.
Your statutory rights are not affected by these
Terms and Conditions.
These Terms and Conditions may be amended from
time to time and such amendments will come into force on the day
following the date of amendment. You should always check to ensure
that you agree with them in relation to each transaction you make.
A security system is in place and instructions
contained in the site in relation to payment should be adhered to
at all times.
You should read our Privacy Policy in conjunction
with these Terms and Conditions.
We
may at any time make changes to the site and the details (including prices)
displayed on it.
We may from time to time establish relationships
with other companies (e.g. our suppliers) that will enable you to
access their
websites. Each of these
companies operates its own privacy policy and we cannot be held responsible
for information gathered by them about you on their site. You must access
such sites at your own risk in this respect.
Working days means Monday to
Friday each week but excluding statutory
holidays.
Before working with electricity or gas, an
experienced professional, a qualified electrician or CORGI fitter,
should be consulted. The
instruction manuals
and safety notices that accompany the products ordered should always
be read and
understood before fitting or connection is attempted. No gas or electricity
connection should be attempted without the involvement of an appropriate
professional.
2. Intellectual Property
2.1 Copyright, trademarks and other intellectual property
rights protect the content of this site. You may retrieve and display
its content on a computer
screen, store such content in electronic form on a disk or print one
copy for your own personal non-commercial use provided all the copyright
and
propriety notices are included and kept intact. You may not store the
site’s content
in a server or other storage device that is connected to a network (other than
the internet).
2.2 There is no implication of any grant to
you of any licence, by use of this site or in the Terms and Conditions,
to use any trade mark of Gasflair or any of its affiliated companies.
3. Sales Terms
and Conditions
3.1 To order goods through the site, you must be at least 18 years of
age.
3.2 Delivery will be to UK only. Delivery of certain products may not
be available for all parts of the UK. We shall inform you in this event. We
will not be held liable for our inability to deliver.
3.3 Each order by you represents an offer to purchase goods subject to
these Terms and Conditions.
3.4 It is not practical for us to publish comprehensive technical details
on the site. Each image, descriptive matter, specification and advertising
on the site is solely to give an approximate description of the goods. Full
detailed specifications are available from most manufacturers’ websites
(see links).
3.5 In relation to 3.4, Gasflair cannot be held responsible for the total
accuracy of the information that is published, though every effort is maintained
to keep the information as accurate and up to date as possible. Therefore,
all the actions taken by users of the goods obtained via the website are their
own responsibility.
3.6 Payment required for goods ordered will be stipulated at the time
when you place the order. We are entitled to amend the price to take account
of any increase in supplier prices, the imposition of additional tax or duty
and any errors or omissions in respect of the price of the goods (including
typographical errors). We will inform you of the prospective change to give
you the opportunity to cancel the order. We shall have the right to refuse
or cancel any orders listed at the incorrect price, whether or not the order
has been confirmed. Any payment already made will be credited without undue
delay by the same method as payment was received.
3.7 The prices published
on the site are inclusive of the current rate of VAT, but exclusive
of Delivery Charges, which, if any, will be indicated
at the time of placing the order at the checkout. Delivery charges may
vary according to your location and the type of product ordered. Please check our
table of prices. Offers and prices charged and displayed in store may differ to those shown on our website.
3.8 We accept most major credit and debit cards including
Visa, MasterCard and Switch. The range of cards we accept may change without
prior notice. When
you order you must provide us with your exact billing address and the telephone
number your card provider has on file for you. There will be difficulty
and delay if these details are incorrect.
3.9 You may also pay
by cheque or postal order subject to payment clearance by the bank
(usually 10days) before despatch of your order. In these circumstances
please telephone our Sales Line, between 9am and 5pm Monday –Friday
, to place your order.
3.10 All
our products and services are subject to availability and may be
withdrawn at any time. If goods are not supplied, no charge will
be made or a
refund, as appropriate, will be made. We will not be responsible
for any losses suffered
by you in relation to our inability to supply.
3.11 Delivery
of stock items will normally be made within 7 working days (i.e. excluding weekends and statutory holidays). Some items, such as cookers,
may be delivered
direct from the manufacturer and may take up to 21 working days. We will endeavour to deliver within the specified times but we cannot
be held liable for any
losses that you may suffer in the event of delay. We will notify
you if it becomes apparent that delivery will be delayed so that
you will have the opportunity
to cancel the order. For delays of more than 21 working days you
will have the right to cancel and be entitled to a refund of any
monies paid, in full.
3.12 As
soon as the goods are delivered to you they become your responsibility. We will deliver only to the address on the order and goods will not
be left without
a signature. From the time of receipted delivery, any loss or
damage to the goods will be your responsibility and at your risk. Any transit
damage, shortages
or wrong goods supplied, must be noted on the delivery/consignment
note at the time of delivery.
3.13 Transit
damage, shortages or wrong goods noted on the consignment note
must be notified to us within 3 working days from delivery.
3.14 You
must notify us of non-delivery of expected orders within
3 days of the due date. Failure to do this will mean that you will
be
responsible for any goods
lost.
3.15 Goods
returned under clauses 3.12 to 3.14 that are found to be
undamaged and in full working order will be re-delivered to you. An administration charge along with
the delivery charge (or actual carriage cost, whichever
is the greater) will be charged to your credit/debit card account.
3.16 Manufacturers
generally guarantee products for 12 months. This guarantee
specifically excludes faults caused by accident, neglect or misuse. You must ensure that a properly
qualified fitter is involved in the installation of your
product (where appropriate, and on all gas installations) otherwise
you may invalidate the guarantee.
3.17 Other
than for items described in clauses 3.13to 3.15, if
you are not totally satisfied with your purchase, for any reason,
you have
the right to cancel your order
within 7 days of delivery and return the goods to us,
in the original packaging. These goods must be in pristine saleable
condition and full working order. You will be wholly responsible for the return of the
goods and any associated costs. We may, at our discretion, arrange
on your behalf for the goods to be
collected from you and your credit or debit card will
be charged with the cost. A
Returned Goods Authorisation note that will be issued
to you must accompany all returns. Goods returned in this way that
are incomplete, damaged or in
any way unsaleable, will be re-delivered to you. An
administration charge along with the delivery charge (or actual carriage
cost, whichever
is the greater)
will be charged to your credit/debit card account. Where goods are being returned in this way, you must contact us to
let us
know and the goods must be despatched
to us within 7 working days of such notification. If
either notification or despatch extends beyond these time limits,
your right to cancel will be revoked.
3.18 After
you have paid for and signed for receipt of the goods,
you will be their owner. We will issue an invoice, either electronically
or by post, upon despatch of
the goods. ]
3.19 We
may fail on occasion to enforce any of these Terms
and Conditions but this will not affect our right to enforce the
remainder of them or to enforce all
of them at some future date.
3.20 Gasflair
is unable to supply its own credit facilities directly
from this site.
3.21 As
a convenience to customers the site includes
links to other websites or to material the accuracy of which is beyond
the control of Gasflair. Gasflair
will not be responsible for the content of
such websites or material nor for any losses that may be incurred
by customers
who use them.
3.22 Gasflair
will be neither responsible nor liable for
any breach of these Terms and Conditions brought about by circumstances
beyond its control.
3.23 Gasflair
will not be responsible for additional
work or re-fitting costs that result from any faulty product that
has
not been installed by Gasflair.
3.24 Installation
services that are available in our stores
are priced to provide a complete sales package. Products bought
through
the Gasflair internet site may be installed
by our stores, at their discretion, but
will be subject to a surcharge for administration and also for
distance
outside a 10 mile radius of the store
(ask in store for details).
3.25 Gasflair
reserves the right to refuse to supply
any goods ordered for any reason.

The following describes our privacy policy.
Gasflair
is committed to the protection of your privacy in relation to the
use of this site. Any information
we collect will be used to process your orders and to provide as comprehensive
